1. Who we are
These Terms and Conditions (the "Terms") govern your use of the Ooni platform (the "Platform"), a service operated by Ooni ("Ooni", "we", "us", or "our"). You can contact us at hello@ooni.education.
By creating an account, submitting an application, or using the Platform in any way, you ("you", the "Oonster" — a prospective student using the Platform — or, where applicable, the "Ooner" — a current student or recent alumnus sharing their experience) confirm that you have read, understood and accept these Terms in full. If you do not agree, you must not use the Platform.
2. What Ooni does
Ooni is an online platform that connects prospective students (the "Oonsters") with selected current students or recent alumni of any educational institution — including universities, business schools, colleges, language schools, vocational and technical institutes, and any other recognised educational provider (the "Ooners") — who share their personal academic and life experience in a specific country, city or institution. Through the Platform, Oonsters can:
- Watch videos and read profiles published by Ooners;
- Book paid chats and paid video calls with Ooners;
- Pay for these interactions through the Platform's internal wallet (the "Wallet").
Ooni acts solely as an intermediary platform between Oonsters and Ooners. Ooni does not provide academic, immigration, legal, financial or medical advice. Information shared by Ooners reflects their personal experience only and must not be treated as professional advice.
3. Eligibility
To register as an Oonster or Ooner you must:
- Be at least 18 years old;
- Have full legal capacity to enter into a binding contract under the laws of your country of residence;
- Provide accurate, complete and up-to-date information.
Ooni reserves the right to verify your identity, age and student/alumni status, and to refuse, suspend or terminate any account that does not meet these requirements.
4. Becoming an Ooner — application and selection
Ooners are selected by Ooni at its sole discretion. To apply, you must:
- Complete the application form on the Platform;
- Submit at least two (2) introductory videos in which you present yourself, your educational experience and your life in the relevant country, following Ooni's Community Guidelines;
- Accept these Terms and the Privacy Policy;
- Provide proof of current enrolment, recent graduation or alumni status at a recognised educational institution when requested.
When you create your first video, you will also be offered the optional Image and Video Marketing Consent. Accepting it is not a condition of becoming or remaining an Ooner, and declining it has no effect on your application, your account or your earnings.
Submitting an application does not guarantee selection. Ooni may accept or reject any application without obligation to provide reasons. Selected applicants will receive an Ooner profile that becomes visible on the Platform once approved.
5. Ooner conduct rules
Ooners are public-facing representatives of the Ooni community. These rules are summarised in plain language in the Community Guidelines, which form part of these Terms. As an Ooner, you commit to the following rules at all times:
5.1 No exchange of personal contact details
Ooners must not share, request, or accept any personal contact information with Oonsters, including but not limited to phone numbers, personal email addresses, postal addresses, social-media handles, messaging app identifiers (WhatsApp, Telegram, Signal, Instagram, TikTok, Snapchat, etc.), or any link or code intended to move the conversation off the Platform. All chats and video calls must take place exclusively through the Platform.
5.2 No off-platform payments
Ooners must not request or accept any payment, gift, or benefit outside the Wallet. All compensation must flow through the Platform.
5.3 Respectful, lawful conduct
Ooners must communicate respectfully, honestly and professionally. The following behaviours are strictly prohibited and will result in immediate suspension or permanent removal:
- Racism, xenophobia, discrimination on the basis of nationality, ethnicity, religion, gender, sexual orientation, disability, age or any other protected characteristic;
- Harassment, bullying, threats, intimidation or hate speech;
- Sexual content, sexual solicitation, nudity or any romantic/sexual approach to an Oonster;
- Sharing of false, misleading or defamatory information;
- Promotion of illegal activities, drugs, violence or self-harm;
- Sharing of confidential information of educational institutions, employers or third parties;
- Any conduct that damages the reputation of Ooni, its Oonsters, partner educational institutions or the Ooner community.
5.4 Accuracy
Ooners must only describe their own genuine experience and must clearly state when something is a personal opinion.
5.5 Availability
Ooners are expected to honour booked chats and video calls and to respond within the timeframes indicated on the Platform.
6. Oonster conduct rules
Oonsters must also behave respectfully and lawfully, in line with these Terms and the Community Guidelines. Oonsters must not:
- Request personal contact details from Ooners or attempt to move conversations off the Platform;
- Engage in any harassment, discrimination, sexual or threatening behaviour;
- Record, screenshot or distribute chats or video calls with Ooners without Ooni's prior written consent;
- Use the Platform for any commercial, recruitment or marketing purpose without authorisation.
Ooni reserves the right to suspend, restrict or permanently block any Oonster or Ooner who breaches these rules, with or without prior notice, and to retain any related evidence for legal or disciplinary purposes.
7. Your content — licence to operate the Platform
By uploading videos, photographs, written profiles, audio or any other content (the "Content") to the Platform, the Ooner grants Ooni a non-exclusive, worldwide, royalty-free licence to host, store, technically process (including through our video infrastructure provider), trim, clip, reproduce, display and stream the Content within the Platform — on the Ooner's profile, in search results, and in the features through which Oonsters discover and book Ooners — and to make the adaptations strictly necessary for that purpose (formatting, compression, thumbnails, captions).
This licence exists solely to operate the Platform and provide the service the Ooner signed up for. It ends when the Ooner removes the relevant Content or deletes their account, subject to the retention rules in the Privacy Policy.
This licence does not include any use of Content in Ooni's marketing, advertising, social media or partner campaigns. Such use requires the Ooner's separate, optional Image and Video Marketing Consent, which is off by default, can be declined without any consequence, and can be withdrawn at any time. Content already used in marketing under an active Marketing Consent is governed by the terms of that consent.
Ooners confirm that:
- They are the sole authors and owners of the Content they submit, or have obtained all necessary rights and consents from any third party appearing in the Content;
- The Content does not infringe any intellectual property, image rights, privacy rights or other rights of any third party;
- They have not undertaken any conflicting obligation with another party regarding the same Content.
Ooners hold Ooni harmless from any claim brought by a third party in relation to Content they have submitted.
8. Wallet, payments and withdrawals
8.1 The Wallet
Ooni provides each Ooner with an internal Wallet to receive payment for chats and video calls booked by Oonsters. Wallet balances reflect amounts owed to the Ooner by Ooni and do not constitute a bank deposit, e-money or any regulated financial product.
8.2 Pricing and fees
Prices for chats and video calls are set as indicated on the Platform. Ooni retains a service fee, disclosed before each transaction. The remaining amount is credited to the Ooner's Wallet once the session is completed and any applicable review period has expired.
8.3 Withdrawals
Ooners may request withdrawal of available Wallet funds at any time, subject to (i) a minimum withdrawal threshold, (ii) successful identity verification (KYC), and (iii) the processing times of the chosen payment method. Ooni may, where required by law, withhold amounts for taxes, anti-fraud checks or pending disputes.
8.4 Taxes
Ooners are solely responsible for declaring and paying any taxes, social contributions or duties due on amounts received through the Platform in their country of tax residence.
8.5 Refunds and disputes
Oonsters may request a refund within the period and under the conditions set out on the Platform. If a complaint is upheld, Ooni may reverse, freeze or deduct the corresponding amount from the Ooner's Wallet. Ooni's decision on disputes between Oonsters and Ooners is final, without prejudice to the parties' legal rights.
8.6 Inactive accounts
Wallet funds in accounts that have been inactive for an extended period may be subject to administrative fees or, where permitted by law, transferred in accordance with applicable rules on dormant balances.
9. Cancellation, suspension and termination
9.1 By the Ooner / Oonster
You may close your account at any time from your profile settings. Upon closure, your public profile will be removed within a reasonable period and any remaining Wallet balance will, subject to verification and applicable fees, be paid out to your registered payment method. Account and data deletion are handled as described in the Privacy Policy and at ooni.education/delete-account.
9.2 By Ooni
Ooni may, at its sole discretion and at any time, restrict, suspend, block or permanently terminate any account in case of:
- Breach of these Terms, the Privacy Policy or the Community Guidelines;
- Disrespectful, racist, discriminatory, harassing, sexual, fraudulent or otherwise unlawful behaviour;
- Risk to the safety, reputation or legitimate interests of Ooni, Oonsters, Ooners or third parties;
- Repeated low-quality service, no-shows or unjustified cancellations;
- Court order, regulatory request or applicable legal obligation.
Where the breach is serious, Ooni may terminate without prior notice.
9.3 Effects of termination
Termination does not affect (i) accrued rights and obligations of the parties, (ii) the terms governing Content already used in marketing under an active Image and Video Marketing Consent, or (iii) Ooni's right to retain data as required by law and as described in the Privacy Policy. The Platform display licence in Section 7 ends on termination.
10. Personal data, privacy and recording
Ooni processes personal data as Data Controller in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on Data Protection and Digital Rights (LOPDGDD). Full information on the categories of data processed, legal bases, recipients, transfers, retention periods and your rights as a data subject (access, rectification, erasure, restriction, portability, objection and the right to lodge a complaint with the Spanish Data Protection Agency, AEPD) is set out in our Privacy Policy, which forms an integral part of these Terms.
Chats are stored, and video calls are recorded, for safety, moderation, dispute resolution and fraud prevention. Chats are screened automatically for content prohibited by these Terms (for example attempts to exchange personal contact details or to move payments off the Platform); human review of chats and call recordings takes place only where a report, dispute or legal obligation requires it. Call recordings are kept for 90 days and then deleted automatically, are accessed only where a report, dispute or legal obligation requires it, and are never used for marketing or any other purpose. Both participants are notified that recording takes place. Details are set out in the Privacy Policy.
11. Intellectual property of the Platform
All rights in the Platform, including software, design, trademarks, logos, databases and editorial content (other than Oonster and Ooner Content) belong to Ooni or its licensors. No right of use is granted other than the limited, non-exclusive, non-transferable right to use the Platform for its intended purpose. Reverse engineering, scraping, mass extraction or commercial reuse of the Platform is prohibited.
12. Disclaimers and limitation of liability
To the maximum extent permitted by law:
- The Platform is provided on an "as is" and "as available" basis. Ooni does not guarantee uninterrupted, error-free or fully secure operation;
- Ooni is not responsible for the accuracy, completeness or usefulness of information shared by Ooners, nor for decisions taken by Oonsters on the basis of such information;
- Ooni is not party to any direct relationship that Oonsters and Ooners may attempt to establish outside the Platform, and accepts no liability for any harm resulting from such off-platform contact;
- Ooni's aggregate liability towards any Oonster or Ooner, for any cause and across all claims, is limited to the amounts actually paid by or to that person through the Platform during the twelve (12) months preceding the event giving rise to liability;
- Ooni shall not be liable for indirect or consequential damages, loss of profit, loss of opportunity, loss of data or reputational harm.
None of the above limits liability for fraud, gross negligence, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law (including consumer-protection rules).
13. Indemnity
You agree to indemnify and hold harmless Ooni, its directors, employees and partners from and against any claim, damage, loss, fine or expense (including reasonable legal fees) arising out of: (i) your breach of these Terms; (ii) Content you submit; (iii) your interactions with other Oonsters or Ooners; or (iv) your violation of any law or third-party right.
14. Changes to the Terms
Ooni may update these Terms to reflect legal, technical or business changes. Material changes will be notified by email or through the Platform at least fifteen (15) days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms. If you disagree, you may close your account before the effective date.
15. Governing law and jurisdiction
These Terms are governed by the laws of Spain, without prejudice to the mandatory consumer-protection rules of your country of residence within the European Union. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Barcelona, Spain, except where mandatory consumer law gives consumers the right to bring proceedings before the courts of their place of residence.
Consumers in the EU may also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
17. Acceptance
By ticking the "I accept the Terms and Conditions" box and submitting your application or registration on the Ooni Platform, you confirm that you have read, understood and accept these Terms in full, together with the Privacy Policy.
Note: Ooni is currently in the process of being formally registered as a legal entity in Spain. Full corporate details (registered name, NIF/CIF and registered office) will be added to this document once registration is complete.
